RECENT EXAMPLES OF OUR EFFECTIVE REPRESENTATION TO THE TAX AUTHORITIES
• A client, who was temporarily out of Canada for about 4 years, managed to maintain significant residential ties with the country during her absence. However, the CRA determined that the client was a non-resident of Canada during the period of absence and, on that basis, was assessed with an overpayment of over $10,000 on account of benefit programs amounts received after she had left Canada. We filed an objection and the CRA Appeals Division agreed with our representation that the client was a factual resident of Canada during the period of absence. The assessments were vacated, and the client received benefits programs refund of over $21,000 covering the period of absence. • The CRA reassessed a client for two taxation years resulting in tax payable of over $40,000. Following our effective representation that there was no basis for the reassessments, the CRA accepted our revised computations, reversed their reassessments and refunded the excess charges to the client.
